This marketing program is being run by IndusInd ( Bank ) onwww.flipkart.com, Flipkart mobile app and Flipkart mobile site (collectively Platform ), which Platform is owned and operated by Flipkart Internet Private Limited ( Flipkart , We or Our ). It is open to all residents of India holding a valid and current IndusInd Bank Debit & Credit Cards ( Cardholder and Card ).
By participating in the Offer (defined below), Cardholder agree to be bound by:
these terms and conditions ( T&C );
the Terms of Use, Privacy Policy and other relevant documentation including any modifications, alterations or updates
thereof, that are published on the Platform; and
all applicable terms and conditions of IndusInd
Offer Details
20% instant discount (herein referred to as “The Offer”) on purchase of Groceries
The Offer is valid from 20th April, 2019 (00:00 Hours) to 25th April, 2019 (23:59 Hours) ( Offer Period ).
To avail the Offer, You must do/ fulfil the following:
Age must be 18 years or above;
Must have a valid account on the Platform and log into the same
Purchase an eligible product.
Purchase of Product/s must be made by using Your valid and current IndusInd Bank Debit & Credit Cards.
The minimum NCV to avail this Offer is INR 1500, and the maximum discount per Card during the Offer Period is INR 400 . NCV shall mean the total value of only the eligible product/s in the cart after all applicable discounts and exchange offer redemptions.
The Offer is also applicable on IndusInd Bank Credit Card EMI transactions.
In case of making partial payments through Flipkart Gift Voucher/Wallet, the discount will be calculated on transaction amount paid through IndusInd Bank Debit & Credit Cards, and this amount should be more than INR 1500 to avail the Offer.
Detailed Terms and Conditions
Offer is not applicable on purchase of infant milk substitutes and infant foods
Add on Cards will be treated as separate cards.
The Offer is not applicable on Card-on-delivery transactions.
This Offer is also valid on EMI transactions done using Credit Cards.
The Offer is NOT applicable on Corporate & Commercial Cards.
This Offer is not applicable on transactions made through Internet Banking.
The Offer is not applicable on Gift Wrap or premium delivery charges.
Delinquent and over-limit Cardholders will not qualify for this Offer.
In case of cancellation of your order, transaction will not qualify for the Offer.
In case the Cardholder makes partial payment through Flipkart Gift Card/Wallet, the Offer will apply only on the net amount paid through IndusInd Bank Debit or Credit Card. In such cases, amount to be paid through Card should not be less than INR 1500.
IndusInd Bank does not endorse any of the products or brands being offered under this Offer and will not accept any liability pertaining to the quality, merchantability, fitness, delivery or after sales service of such products which shall be at the sole liability of the sellers on the Platform. IndusInd Bank shall not entertain any such disputes even if, the customer approaches for resolution of the same.
In the event orders are cancelled, the corresponding value will be deducted from the paid amount while checking eligibility of Discount.
IndusInd Bank holds the exclusive right at its sole discretion to refuse or deny the Offer to any Cardholder. The Cardholder shall become ineligible to participate in this Offer if his/her card is cancelled before the expiry of /during the Offer Period. IndusInd reserves the right to disqualify any Customer from the benefits of the campaign / offer, if any fraudulent activity is identified as being carried out by the customer for the purpose of availing the benefits under the campaign/offer or otherwise by use of the service.
Any taxes or liabilities or charges payable to the Government or any other authority or body, if any, shall be borne directly by Cardholder and/ or billed to the account of the Cardholder.
This Offer may be withdrawn or extended at any time at the sole discretion of IndusInd Bank or Flipkart.
IndusInd Bank is not making any commitment to make such similar offers beyond the Offer period.
The above Offer is by way of a special offer for Bank Credit Cardholders only and nothing contained herein shall prejudice or affect the terms and conditions of the card member agreement. The terms of the above schemes shall be in addition to and not in derogation of the terms contained in the card member agreement.
IndusInd Bank & Flipkart reserve their absolute right at any time to add, alter, withdraw, modify or change or vary any or all the terms and conditions of the Offer at their sole discretion and the same shall be binding on the Cardholder at all times. IndusInd Bank & Flipkart also reserve the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever. In case of any dispute, IndusInd Bank’s decision shall be binding.
The Offer shall be subject to usual force majeure events and on occurrence of such event, the Offer may be withdrawn at the discretion of IndusInd Bank.
Pictures of products shown in the communication sent to you either through mailers or advertised on Platform are for representative purpose only and may not bear a resemblance to the actual products sold on the Platform.
Under no circumstance will the Offer/discount being offered under this program be settled in cash.
All government levies like Sales Tax, TDS, any Local Tax, Octroi etc., shall be payable by the Cardholder as applicable at the time the respective Programs were offered.
Any disputes arising out of the Offer shall be subject to arbitration by a sole arbitrator appointed by both the Parties with mutual consultations for this purpose. The proceedings of the arbitration shall be conducted as per the provisions of Arbitration and Conciliation Act, 1996. The place of arbitration shall be at Mumbai and language of arbitration shall be English. The existence of a dispute, if any, shall not constitute a claim against Bank.
You are not bound in any way to participate in the Offer. Any such participation is voluntary and the same is being made purely on a best effort basis.
Any query regarding the program will be entertained until 10th May 2019. Post such date, Flipkart or IndusInd Bank will not entertain any correspondence or communication regarding this Offer from any person/s.
This Offer shall be subject to all applicable laws, rules and regulations which are in existence and which may be promulgated anytime by any statutory authority.
All liability with respect to the Products purchased lies with the seller of the Product and IndusInd Bank/Flipkart shall be in no way responsible for the same.
Flipkart shall not be liable for any failure by the Bank to honor the transaction and for any technical issues as a result of which the transaction made by the Cardholder was not successful. The Bank shall indemnify and hold the Cardholder harmless against any claims by the Cardholder for unsuccessful completion of the transaction. Further, the Bank shall solely be liable to the Cardholder for wrongful remittance of the amounts by it.
Products under this Offer are subject to availability from the respective participating merchants/sellers of Flipkart and accordingly Bank or Flipkart in no circumstances shall be liable for non-availability of any of the products.
Returned transactions, disputed or unauthorized/fraudulent transactions will not be considered for the Offer.
The Cardholder shall indemnify and hold Flipkart, Bank and seller harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by such sellers as a consequence of (i) violation of these terms and conditions, of the terms of user agreement, privacy policy (subject to change) as mentioned on the Platform; (ii) violation of applicable laws; and (iii) any action or inaction resulting in willful misconduct or negligence on the part of the customer.
This Offer is valid only in India. The minimum age of such Cardholder must be 18 years.
Further, as required by applicable law, in the event that the Cardholder makes a purchase of an amount equal to or above Rs. 200 000.00, the Cardholder will be required to upload a scanned copy of his/her PAN card on the Platform, within 4 days of making the purchase, failing which, the purchase made by the Cardholder will be cancelled. The requirement to submit the PAN card arises only once and if it has been submitted once by the Cardholder, it need not be submitted again. The order of the Cardholder will be cancelled if there is a discrepancy between the name of the Cardholder and the name on the PAN Card.
