PRELIMINARY

○ This Offer (defined below) is being run by Omnitechretail on www.flipka...om, Flipkart Mobile App, Flipkart Lite Platform (all three collectively “Platform”), which Platform is owned and operated by Flipkart Internet Private Limited (“Flipkart”).

○ By participating in this Offer (defined below), the user (“Customer” or “You” or “Your”) agrees to be bound by these terms and conditions (“T&C”); the Terms of Use, Privacy Policy and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Platform.

OFFER DETAILS

The Offer will commence at 00:00 Hrs 4th September,2020 to 23:59 Hrs 7th September,2002 (“Offer Period”).

To participate in the Offer, you must do/ fulfil the following:

· Age must be 18 years or above;
· Must have a valid account on the Platform and log into the same;
· The Offer can be availed only once during the Offer Period by You.

2. In case partial payment is made through Flipkart Gift Card, Offer will apply only on the amount paid through the PhonePe against the purchase of eligible products.

OTHER TERMS AND CONDITIONS

1. This Offer is valid only in India except for the state of Tamil Nadu.
2. The Offer is open only to the end consumers and not the resellers of the Eligible Product(s).
3. Offer is non-transferable and is subject to availability of stocks.
4. This Offer is being run by Seller on Flipkart Platform.
5. Customers are not bound in any way to participate in this Offer. Any participation is voluntary, and the Offer is being made purely on a best effort basis.
6. Flipkart, in its sole discretion, reserves the right to disqualify You from the Offer and/or the benefits of this Offer, if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the said Offer.
7. The Offer shall be subject to force majeure events and on occurrence of such an event, the Offer may be withdrawn at the discretion of the Seller and/or Flipkart.
8. Flipkart shall not be responsible for any loss, injury or any other liability arising due to participation by any person in this Offer.
9. Flipkart does not endorse the products sold on the Platform and will not accept any liability pertaining to the quality, merchantability, fitness, delivery or after sales service of Product(s). Flipkart shall not be responsible towards any delay or failure of delivery of the Product to any Customer(s) during the provided timeline.
10.Customer understands that this Offer and other offers are provided by Seller(s) on the Flipkart platform and Flipkart shall not be liable towards the quality of the Product and/or fulfilment of the Offer and/or warranty claims and/or after sales services of the Product(s) and/or taxes arising out of the same. Any claim or dispute in relation to the same must be directed towards Seller only.
11.This Offer is neither created/owned nor sponsored by Flipkart. Flipkart shall not be responsible if this Offer is in violation with any applicable law. Seller shall be solely responsible towards any losses suffered by and/or penalties levied on Flipkart due to this offer being in contravention to any applicable laws.
12.Customer hereby agree to abide by the terms and conditions and privacy policy and other documents as may be applicable to him/her while accessing the Platform also to indemnify and keep Flipkart harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by Flipkart as a consequence of (i) violation of terms of this T&C and other terms of the Platform by Customer; (ii) violation of applicable laws; (iii) any action or inaction resulting in wilful misconduct or negligence on Customer’s part.
13.This T&C shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this T&C.
14.Any query regarding this Offer will be entertained only by Seller.
15.Flipkart will not entertain any correspondence or communication regarding this Offer from any customer/persons.
16.The Offer shall be subject to the Income-Tax Act, 1961 and all disbursements shall be subject to TDS, as applicable.
17.This document is an electronic record in terms of Information Technology Act, 2000, and the Rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.
