TERMS AND CONDITIONS

1.This limited period promotional ‘Bose Week’ offer (“Offer”) is provided to you by Bose Corporation India Private Limited (“Bose”) and is made available by Amazon Seller Services Private Limited (“Amazon”) on the website www.ama...in and the corresponding mobile site and mobile application (collectively, “Amazon.in”). Bose has provided this Offer in respect of its products listed on Amazon.in by Appario Retail Private Limited (“Seller”).
2.These Offer terms and conditions (“Offer Terms”) are in addition to the Amazon.in Conditions of Use & Sale and Privacy Notice to which you agree by using Amazon.in. To the extent the Amazon.in Conditions of Use & Sale and/ or Privacy Notice are inconsistent with these Offer Terms; these Offer Terms will prevail with respect to this Offer only.
3.This Offer is valid from 00:00:00 hours to 23:59:59 hours on September 2, 2019 (the “Offer Period”), unless extended or revoked by Bose in its sole discretion, without any prior notice and without any liability.
4.Subject to the Offer Terms, during the Offer Period, any customer who purchases the Bose products listed on Amazon.in by the Seller of the invoice value ranging between the limit specified below, will be eligible to receive the below cashback value in the form of Amazon Pay balance (“Benefit”):
a. For order value between INR 15,000 to 33,000 customers will receive Amazon Pay balance of INR 2500.
b. For order value between INR 33,001 to 40,000 customers will receive Amazon Pay balance of INR 3800.
c. For order value between INR 40,001 to 50,000 customers will receive Amazon Pay balance of INR 5300.
d. For order value above INR 50,000, customers will receive Amazon Pay balance of INR 7800.
5.The participation of a customer will be deemed to be withdrawn from this Offer if the purchase transaction: (a) is cancelled (for any reason whatsoever) by the customer or the Seller or by Amazon; or (b) is returned by the customer, if the amount of the order falls below the minimum order amount eligible to avail this Offer (INR 15,000). In such cases, if cashback has been received by the customer, amount of the cashback will be deducted from the transaction amount, at the time of refund to the customer (if any). Notwithstanding the above, if the amount of the order after adjusting the amount of cancellation or refund is above the minimum order amount of INR 15,000, the customer will be eligible to receive the aforesaid Benefit under this Offer. For the avoidance of doubts, it is clarified that the mode of refund will be governed by the applicable terms.
6.The Benefit, under this Offer, will be provided to the eligible customers by 30th October , 2019 in the form of an Amazon Gift Card, issued by Qwikcilver Solutions Private Limited, which is redeemable as Amazon Pay balance. The use and redemption of Amazon Gift Card is governed by the applicable terms and conditions available at Amazon.in.
7.The Benefit under this Offer is funded by Bose, to the total exclusion of Amazon. By participating in this Offer, you expressly agree that Amazon or any of its affiliates will not be liable or responsible for any loss or damage whatsoever that you may suffer, directly or indirectly, in connection with this Offer, including but not limited to that associated with your use or delivery or misuse of any product purchased through Amazon.in.
8.The decisions of Bose and its representatives regarding organizing/ running / process/ results of the Offer, shall be final and binding on all the participants of the Offer. No appeals will be entertained in this regard.
9.Under no circumstance, unless due to wilful misconduct or gross negligence, shall Amazon, Bose and/or their respective directors, employees, officers, affiliates or subsidiaries, be liable to the customer and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever.
10.All information provided in the Offer is provided “as is” without warranty of any kind. Neither Amazon nor its affiliates make any representations and disclaims all express, implied, and statutory warranties of any kind to the customer and/or any third party including, without limitation, warranties as to accuracy, timelines, completeness, merchantability, or fitness for any particular purpose. You hereby release Amazon and its affiliates from liability of any kind relating to the mentioned above.
11.In case a customer is eligible for any other offer(s) and is entitled to benefits under such other offer(s) in addition to this Offer, such customer will be eligible to avail benefits under this Offer as well as such other offers, i.e. for both the offers.
12.Bose reserves the right, at any time, without prior notice, without liability, and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these Offer Terms or to replace, wholly or in part, this Offer by another offer, whether similar to this Offer or not.
13.Benefit under this Offer is not transferable, assignable or exchangeable. The Benefit cannot be negotiated or refunded, and by no means will cash equivalent be given. Failure by Amazon to enforce any of these Offer Terms in any instance shall not be deemed a waiver of the Offer Terms and shall not give rise to any claim by any person.
14.All disputes between the customer and Bose in relation to the Offer or any claim related thereto will be resolved inter se and Amazon will not (nor will be liable or obliged to) mediate or resolve any dispute or disagreement between them. Amazon will not be responsible and/ or liable for handling, entertaining or resolving any queries or grievances regarding the use or misuse of the Offer in any manner whatsoever.
15.Any query/ issue in relation to the Benefit or this Offer should be addressed to Bose at https://www.boseindia.com/en_in/suppor...ml on or before 15th Nov, 2019. Post such date Bose will not entertain any communication regarding this Offer or Benefit from any person.
16.Any taxes as per the applicable laws, rules and regulations of Central/state government or local authorities shall be borne by the customer.
17.Nothing herein amounts to a commitment by Bose or Amazon to conduct further, similar or other offers.
18.This Offer is valid only for purchase made in respect of Bose products listed on Amazon.in by the Seller and cannot be extended to any other products or services from Bose or listed by any other seller. Application of the Offer on the products cannot be challenged or disputed.
19.Customer is not bound in any way to participate in this Offer. Any participation is voluntary. The Offer is being made purely on a best effort basis.
20.All standard terms and conditions with respect to purchases made will be applicable. Any person availing this Offer shall be deemed to have accepted these Offer Terms.
21.The Offer shall be governed by and construed in accordance with the applicable laws in India. All matters with respect to the Offer are subject to the exclusive jurisdiction of the courts at New Delhi only
