Under thisOffer, the customers who purchase Eligible Products (defined below) from the Platform would receive a voucher code (“Voucher Code”) through which the customer becomes entitled to receive Rs. 100/- (One Hundred Only) Cashback in ZebPay Wallet on the Customer’s first trade of Rs. 500/- (Five Hundred Only) on
ZebPay. To check the Offer eligibility, please check the product page of the Eligible Products on the Platform before making any purchase. (“Offer”)

● What is the Eligible Product for this Offer?
This Offer is eligible on select mobile devices selected by Awlencan Innovations Malta Limited (“Brand”) on the Platform. For more details, please visit the product page on the Platform. (“Eligible Products”)

● What is the duration of the Offer?
The Offer Period is from 12:00 hrs on 3rd December 2021 to 23:59 hrs on 20th January 2022.

What is the duration of the Redemption Period?
After the delivery of the Eligible Product that is purchased from the Platform, the Customer can redeem the Offer. Last date for redeeming the Offer is 1st March 2022. (“Redemption Period”)

How to claim the offer?

1. Purchase Eligible Products from the Platform (defined below) and receive the unique Voucher Code (“Voucher Code”) in the “My orders” section on the “Order Details” page on the Platform, after the delivery of the Eligible Product so purchased.

TERMS AND CONDITIONS (T&C)

PRELIMINARY

This Offer is being run by Jeeves Consumer Services Private Limited (Jeeves) in partnership with Awlencan
Innovations Malta Limited, on www.flipka...om,
Flipkart Mobile App, Flipkart Lite Platform (all three collectively “Platform”), which Platform is
owned and operated by Flipkart Internet Private Limited (“Flipkart”). The Offer is being
funded wholly by Awlencan Innovations Malta Limited(“Brand”)
.

By participating in this
Offer (defined below), the user (“Customer” or “You”
or “Your”) agrees to be bound
by:

a. these
terms and conditions (“T&C”);
b.
the Terms
of Use, Privacy Policy and other relevant documentation including any
modifications, alterations or updates thereof, that are published on the
Platform and
c.
All
applicable terms and conditions of the Brand.

OFFER DETAILS

The Offer will commence at 12:00
hrs on 3rd December 2021 to 23:59 hrs on 20th January 2022(“Offer Period”). To participate in the Offer, You must do/ fulfil the
following:

a. Age must be 18 years or above;
b. Must have a valid account on the Flipkart Platform and log into the same;
c. Purchase an Eligible Product from the Platform and receive a voucher code after the
product is delivered.
d. Only one voucher code will be distributed per order.
e. The Offer can be availed only once during the Offer Period by You.
f. Steps to redeem the voucher code:
The customer would receive a unique voucher code (“Voucher Code”) in the
“My orders” section on the “Order Details” page on Platform, after the delivery
of the Eligible Product that is purchased by the Customer..

g. Steps to claim the offer on ZebPay platform -

You acknowledge and confirm that You are aware of the nature of
telecommunications/ internet services and that an email transmission may
not be received properly and may be read or be known to any unauthorised
persons. You agree to assume and bear all the risks involved in respect of
such errors and misunderstanding and Jeeves or the Brand shall not be responsible in any manner

In the event You cancel any order placed
during the Offer, You shall not be eligible for the Offer.

OTHER TERMS AND CONDITIONS

This Offer is valid only in India.

The Offer is open only to the end consumers who are citizens and
residents of India and not the
resellers of the Eligible Product(s).

Offer is non-transferable and is subject to availability of
stocks.

Customers are not bound in any way to participate in this Offer.
Any participation is voluntary, and the Offer is being made purely on a
best effort basis.

Flipkart or Jeeves, in their discretion, reserves the right to
disqualify You from the Offer and/or the benefits of this Offer, if any
fraudulent activity is identified as being carried out for the purpose of
availing the benefits under the said Offer.

Discount
shall not be settled with cash in lieu by Flipkart or Jeeves and are not
transferable.

The
Offer shall be subject to force majeure events rendering Jeeves/Brand’s
and/or Flipkart unable to extend the Offer, for
reasons beyond Jeeves/Brand’’s and/or Flipkart’s control, such
as, but not limited to Acts of God, acts of civil or military authorities,
acts of public enemy, terrorist attacks, war, threat of war, destruction
of network, strikes, lock-out, riots, civil disturbances, political
disturbances, insurrections, accidents, explosions, fire, earthquake,
flood, epidemics, pandemics, lockdowns, acts of government, agencies or
officers, volcano, volcanic ash, natural calamities, or any other
legitimate cause restraining performance and on occurrence of such an
event, the Offer may be completely or partially withdrawn at the
discretion of Jeeves/Brand’s and/or Flipkart .

Brand, Jeeves and Flipkart reserves the
right at any time to change, modify, withdraw, extend or terminate this
Offer at their discretion, without any prior notice and without any
liability or obligation in this regard.

This
Offer cannot be clubbed with any other promotion/discount of Brand or
Flipkart.

Flipkart and Jeeves shall not be responsible for any loss, injury
or any other liability arising due to participation by any person in this
Offer.

Flipkart and Jeeves does not endorse the products sold on the
Platform and will not accept any liability pertaining to the quality,
merchantability, fitness, delivery or after sales service of Product(s).
Flipkart and Jeeves shall not be responsible towards any delay or failure
of delivery of the Product to any Customer(s) during the provided
timeline.

Customer understands that this Offer and other offers are
provided by Brand on the Flipkart platform and Flipkart and Jeeves shall
not be liable towards the quality of the Product and/or fulfilment of the
Offer and/or warranty claims and/or after sales services of the Product(s)
and/or taxes arising out of the same. Any claim or dispute in relation to
the same must be directed towards Brand only.

This Offer is neither created/owned nor sponsored by Flipkart and
Jeeves . Flipkart and Jeeves shall
not be responsible if this Offer is in violation with any applicable law. Brand shall
be solely responsible towards any losses suffered by and/or penalties
levied on Flipkart due to this offer being in contravention to any
applicable laws. Notwithstanding anything to the contrary provided
hereunder this T&C and the Frequently Asked Questions, Brand shall
indemnify Flipkart and/or Jeeves
against all damages, liabilities, costs, expenses, claims, suits
and proceedings (including reasonable attorney’s fee) that may be suffered
by Flipkart and/or Jeeves a) due
this Offer (or part of Promotion) being in contravention with any
applicable laws; b) due to any act or omission of Brand
; c) claim by any third party for any breach/infringement of their
proprietary/intellectual property rights; d) claim raised by any customers
against Flipkart in relation to this Offer.

Customer hereby agree to abide by the terms and conditions and
privacy policy and other documents as may be applicable to him/her while
accessing the Platform also to indemnify and keep Flipkart and/or
Jeeves harmless against all
damages, liabilities, costs, expenses, claims, suits and proceedings
(including reasonable attorney’s fee) that may be suffered by Flipkart
and/or Jeeves as a consequence of
(i) violation of terms of this T&C and other terms of the Platform by
Customer; (ii) violation of applicable laws; (iii) any action or inaction
resulting in wilful misconduct or negligence on Customer’s part.

This T&C shall be governed in accordance with the applicable
laws in India. Courts at Bengaluru, India
shall have the exclusive jurisdiction to settle any dispute that
may arise under this T&C.

Any query regarding this Offer will be entertained only by Brand on
following contact details:

Flipkart and Jeeves will not entertain any correspondence or
communication regarding this Offer from any customer/persons.

The Offer shall be subject to the Income-Tax Act, 1961 and all
disbursements shall be subject to TDS, as applicable.
